Terms of service

These terms govern your use of DOMs_DMs, an AI-assisted direct-message platform for coaches. By creating an account or using the service you agree to them. If you don’t agree, don’t use the service.

1. The service

DOMs_DMs provides software that connects to a coach’s Instagram business account to read incoming direct messages, classify them, draft replies in the coach’s configured voice, and — when explicitly enabled — automatically send those replies. The service includes an inbox UI, analytics, configuration tools, and operational tooling around it.

2. Eligibility and account

  • You must be at least 18 years old and able to form a binding contract.
  • You are responsible for all activity that occurs under your account, including activity by people you invite.
  • You must keep your login credentials and any API tokens you generate confidential. Notify us immediately if you believe they have been compromised.
  • You must connect your own Instagram business account, or one you are explicitly authorized to operate. Connecting accounts without authorization is prohibited.

3. Acceptable use

You will not, and will not enable anyone else to:

  • Send messages that are spam, deceptive, harassing, hateful, sexually explicit, or that promote violence, fraud, or discrimination.
  • Impersonate another person or business in your replies.
  • Use the service to send messages outside the messaging policies of Meta, including the 24-hour standard messaging window, the limits on automated replies, and any rate limits imposed by the Instagram Messaging API.
  • Attempt to circumvent guardrails, kill switches, spend caps, or rate limits we operate.
  • Reverse engineer, scrape, or attempt to access another tenant’s data. The service uses tenant-isolated storage and any cross-tenant probing will result in immediate suspension.
  • Use the service to violate any applicable law, including consumer-protection, telemarketing, and AI-disclosure rules in your jurisdiction.

Violations may result in immediate suspension or termination without refund.

4. AI disclosure

The service drafts and may automatically send replies using AI. Some jurisdictions require disclosing this to consumers. The service supports a configurable first-reply disclosure for each tenant. Configuring and enabling that disclosure where the law of your jurisdiction (including but not limited to California AB 2905) requires it is your responsibility, not ours.

5. Your content

You retain ownership of the messages, profile data, and configuration you bring into the service. You grant us a limited, non-exclusive license to host, transmit, store, display, and process that content for the sole purpose of operating and improving the service for you. We do not use your content to train third-party foundation models, and we do not share it outside the sub-processors disclosed in our privacy policy.

6. Subscriptions and billing

Paid plans are billed in advance on a monthly or annual basis. Pricing is shown at signup and in your account settings. Fees are non-refundable except where required by law, but you can cancel any time and avoid future charges. We may change prices with at least 30 days notice; changes take effect at the start of your next billing period.

7. Beta and unreleased features

We may flag features as “beta,” “preview,” or behind a feature flag. Beta features are provided as-is, may change or be removed, and are not subject to any service-level commitments.

8. Service availability

We aim to keep the service available 24/7 and we monitor it actively. We don’t guarantee uninterrupted service. Scheduled maintenance is announced in advance when feasible. We are not liable for downtime caused by Meta, our database provider, our hosting provider, or other upstream services outside our control.

9. Termination

  • You can close your account from settings or by emailing support@domsdms.ai. On closure we disable automation immediately and delete your data per the schedule in our privacy policy.
  • We can suspend or terminate access for material violation of these terms (including violations of Meta’s platform rules), for non-payment, or where required by law. We try to give notice when we can.

10. Disclaimers

The service is provided as-is. We make no warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that AI-generated drafts are accurate, fit for sending, or compliant with all applicable laws — you remain responsible for the messages that go out under your business identity.

11. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost revenue, or lost data. Our aggregate liability under these terms in any 12-month period is limited to the fees you paid us in that period (or $100 if no fees were paid).

12. Indemnification

You will defend and indemnify us against third-party claims arising from (a) your messages or content, (b) your violation of these terms, (c) your violation of any law applicable to your business, or (d) your violation of Meta’s platform rules.

13. Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to conflicts-of-law rules. Disputes will be brought in the state or federal courts located in the State of Delaware, United States, and the parties consent to the personal jurisdiction of those courts.

14. Changes to these terms

We’ll update this page when these terms change. Material changes will be announced inside the product and to the email tied to your account at least 14 days before they take effect. Continuing to use the service after that date means you accept the updated terms.
